  1. TERMS & DEFINITIONS
    RUE RA – is the trade name of S.C. RUERA DESIGN S.R.L with registered offices in Romania at Str. Aleea Elevilor, Nr. 1, Bloc 55G, Scara A, Etaj PARTER, Apt. 2, Ploiești with business register number J29/1124/2022, tax identification number 46032167. The terms “Vendor”, “we”, “us”, “our”, “website” refer to RUE RA.
    Vendor – or RUE RA is acting in his name or on his behalf, for purposes relating to his trade, business, craft or profession in relation to contracts covered by European law. The Vendor offers Goods for sale on www.ruerastudio.com and its e-commerce business  services which are available exclusively to its end users, i.e. the “Consumers”.
    Consumer – shall mean any individual over the age of 16 (sixteen) who is acting on www.ruerastudio.com for purposes which are outside his or her trade, business, craft or profession.
    User – any individual over the age of 16 (sixteen) registered on the Site, who, by creating an Account, has given his consent to the site-specific clauses in the Terms and Conditions section.
    My Account – is a section of the Site dedicated to Users. To make an Account the User has to complete the process of creating it by providing an email address, a password and personal data. The user is responsible and will ensure that all information entered when creating the Account is correct, complete and up to date. The Account allows the User to access and manage information about his history on the Site (Orders history, tax invoices, returns, etc.).
    Goods/Products – any items put up for sale listed on the Site, including the products that are contained in any Order, which have to be provided by the Vendor to the Consumer as a result of the Contract.
    Goods made to the consumer’s specifications – means non-prefabricated goods made on the basis of an individual choice or decision by the consumer.
    Website/Site – refers to the online shop, www.ruerastudio.com.
    Order – an electronic document through which the Consumer transmits to the Vendor, through the Site, his intention to purchase Goods from the Site.
    Contract – is a Distance Contract concluded between the Vendor and the Consumer through the e-commerce services provided by the Vendor without the simultaneous physical presence of the Vendor and the Consumer.
    Digital Content – means data which are produced and supplied in digital form.

    Welcome to www.ruerastudio.com (The “Website”). This website is operated by RUE RA. Through the site, the terms “website”, “we”, “our” refer to RUE RA. These Conditions of Use regulate the access to use www.ruerastudio.com, as well as the purchase of Goods on this website assuming that you have read, understood and accepted the Conditions of Use.

The Vendor may amend or update parts or all of these Conditions of Use. Any updates shall be posted for our users on our Home Page of www.ruerastudio.com.     The access to and use of www.ruerastudio.com, including display of web pages, communication with the Provider, downloading product information and purchases on the website, should be exclusively by our User’s personal purpose.

RUERA DESIGN S.R.L. and the authors of any individual work published on www.ruerastudio.com have all the rights to claim the ownership to their works or any other alteration of the modified material.

      www.ruerastudio.com may contain links to other websites which are in no way connected to our Website. RUE RA and the Provider do not control or manage these websites or their contents and must not be held responsible for any rules adopted by them especially regarding your privacy and protection of your personal data processed by the website when you are visiting them. www.ruerastudio.com’s Conditions of Use and Privacy Policy do not apply to other websites not managed by us or our Provider. To avoid any incidents please read the regulations regarding Terms and Conditions, Privacy Policy and any other legal legal information on any new sites you access.

    5. OUR BUSINESS POLICY
      The Vendor’s mission consists of selling goods through the Website strictly to Consumers, for purposes which are outside his or her trade, business or professional activity. If you are not a consumer, please do not use our services of purchasing on www.ruerastudio.com.
    6. APPLICABLE LEGISLATION
      The Conditions of Use are in conformity with Romanian law. If you do not agree with these general Conditions of Use, please do not access and use the Website.
  3. CONDITIONS OF SALE
    The following Conditions of Sale regulate the offer and sale together with the Conditions of Use, Privacy Policy and Returns & Refunds Policy of Goods on www.ruerastudio.com. Goods purchased on our Website are sold directly by S.C. RUERA DESIGN S.R.L (the “Vendor” or “We” or “Us”), with registered offices in Romania at Str. Aleea Elevilor, Nr. 1, Bloc 55G, Scara A, Etaj PARTER, Apt. 2, Ploiești with business register number J29/1124/2022, tax identification number 46032167.

  4. BUSINESS POLICY
    1.  The Vendor offers goods for sale on www.ruerastudio.com and its e-commerce business  services are available exclusively to its end users, i.e. the “Consumers”
    2.  The Vendor reserves the right not to process orders received from individuals who are not “Consumers” and any other order which does not comply with Vendor’s business policy. Also, the Vendor reserves the right to restrict the access of a Consumer / User to place an Order or to some of the accepted payment methods, if we consider that the actions of the Consumer / User on the Site, could harm RUE RA in any way. In any of these cases, the Consumer / User may contact us via email contact@ruerastudio.com in order to be informed about the reasons that made the Vendor refuse an order.
    3.  Communication with the Vendor can be done via email contact@ruerastudio.com.
    4.  All the prices related to the Goods on the Site are expressed in Lei (RON) for orders within Romania and in Euros (EUR) for international orders. All displayed prices include sales taxes.
    5.  For online payments the Vendor cannot be held responsible for any other additional costs borne by the Consumer, including the currency conversion fees applied by the issuing bank of his card, if the currency of its issuance differs from RON or EUR. The responsibility for this action lies solely with the Consumer.
    6. These Conditions of Sale govern the offer, transmission and acceptance of purchase orders relating to Goods on www.ruerastudio.com and the Vendor.
  5. HOW TO PLACE AN ORDER
    1. To place an order for the purchase of one or more goods on our Website, you have to choose your products and their sizes following the relevant instructions and begin the Checkout process with reviewing your Bag. Once added to the shopping Bag the Good is available for purchase to the extent that there is stock available for it. Adding a Product to the Bag, in the absence of completing the Checkout process does not conclude the registration of an order and does not reserve the products.
    2. Once you proceeded to your Checkout, you will go through the order form where you will be given information on the main characteristic of each product ordered and the corresponding unit price (including all applicable fees and taxes), the types of payment methods that you can use, shipping options and the cost for each of them and the Terms and Conditions you have to consider and agree before placing an order.
    3. Before submitting your order, you will be asked to carefully read the Terms & Conditions, Returns & Refunds Policy and Privacy Policy. If you don’t have an Account you will have to confirm that you are over the age of 16 (sixteen). We recommend you to print a copy of these Terms and Conditions for personal use.
    4. By completing the Order, the Consumer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the time of placing the Order.
    5. Romanian (for Romanian orders) and English (for international orders) are the languages used for executing contracts with Vendor, depending on the place the order has been made.
    6. Once your order has been submitted the Vendor will process your order.
    7. The Vendor may refuse to process an Order, following a prior notification addressed to the Consumer, without any obligation of any party to the other or without any party being able to claim damages from the other in the following cases:
      1. If there are no sufficient guarantees of solvency;
      2. Invalidation of the transaction by the card processor approved by RUE RA, in case of online payment;
      3. When orders are incomplete or incorrect
        If the products you ordered on www.ruerastudio.com are no longer available at the time you last accessed the website or submitted your order, the Vendor will inform you within 30 days from the moment the Vendor received your order. If the order has been sent and the payment has already been done, the Vendor will refund the amount paid for the products.
    8. By submitting an order form online, you unconditionally accept these Conditions of Sale. Should you not agree with certain provisions of these Conditions of Sale, please do not place any order on www.ruerastudio.com. Also, by submitting an order, you agree and accept as well the further conditions contained on www.ruerastudio.com, even through links, including the Conditions of Use, Privacy Policy, Cookies Policy, Returns and Refunds Policy, Shipping Policy of www.ruerastudio.com.
    9. Upon submission of an order form, the Vendor will send you a purchase order receipt by email, containing a summary of:
      • Order number;
      • Your delivery and invoicing address;
      • Date of the order;
      • The list of products ordered, their amounts, and detailed information on price;
      • Terms of payment;
      • Shipping method and costs;
      • Return Policy;
        We advise you to keep and print this document, which is official proof of your order. The notification received after making the Order, has the role of information and does not represent the acceptance of the Order. This notification is an automatic response sent via email. 
    10. The contract is deemed to have been concluded on the date on which the Vendor sends you a confirmation email summarizing the content of your order and confirming the dispatch of the same.
  6. GUARANTEES AND PRODUCT PRICE INDICATION
    1. www.ruerastudio.com only offers products bearing the “RUE RA” brand. The products are produced at our headquarters or by manufacturers authorized by our house.
    2. www.ruerastudio.com does not sell second-hand products, flawed products or products of low quality.
    3. Each product page shows the main characteristics of each item sold on www.ruerastudio.com. Please note that the images and the colors of the products offered for sale by www.ruerastudio.com may not correspond exactly to the real products, due to the diversity of mediums through which you access the website (monitor, phone, tablet etc.)
    4. Please check the final price of sale before submitting your order, because prices are subject to change.
    5. Please check the Shipping Policy if your country is on our shipping list. Orders placed from a country outside the Vendor’s shipping area cannot be accepted.
    6. The prices of products do not include customs and duties, for orders outside of the EU. In the case above, the Customer shall cover the costs of customs and duties.
    7. All products sold by www.ruerastudio.com come with an identification tag attached with a disposable seal. Do not remove the tag and the seal, because they are integral parts of the product.
    8. If you request a return, the Vendor may refuse to accept products that are not according to our Returns & Refunds Policy.
  7. INVOICES AND PAYMENT
    1. The Vendor will issue to the Consumer an invoice for the delivered Products. The Consumer has the obligation to provide all the information necessary to issue the invoice in accordance with the legislation in force.
    2. The Vendor will send the invoice to the Consumer by email, to the email address mentioned by the Consumer in his Account or in the order form.
    3. By placing the Order, the Consumer agrees to receive the invoices in electronic format by email, to the email address mentioned in the Account or in the order form.
    4. Payment of the products and the costs for shipping and delivery (for international orders) must be made by using one of the methods provided by www.ruerastudio.com in the order form.
    5. If you pay with credit/debit card, your financial information (e.g. credit/debit card number or the expiry date) will be sent to an external payment service provider: NETOPIA Payments. NETOPIA Payments guarantees the security of the transaction. Neither the Vendor, nor the Payments Provider will ever use your financial data except for performing the procedure relevant to your purchase or processing your refunds in case of a return or for reporting cases of fraud on www.ruerastudio.com to the police.
    6. The price for the products and the costs for their shipping (for international deliveries) as indicated in the order form will be charged the moment you place the order. You will receive your invoice via email.
    7. For transaction security reasons, the User is advised not to remain logged on to the Site and not to set the option of automatic login on mobile devices. Disclosure of the account password is not permitted. We recommend you to use a strong security password (e.g. to contain at least eight characters, including uppercase, lowercase, numbers, and special characters).
  8. SHIPPING AND DELIVERY OF THE PRODUCTS
    For information on shipping and delivery procedures, please access Shipping & Delivery Policy section. Please read the sections carefully. The information is an integral part of these Conditions of Sale and has to be fully read and accepted by you at the time you submit your order.

  10. RIGHT TO WITHDRAW
    The Consumer shall have a period of 14 days to withdraw from a distance contract, without giving any reason. Therefore, being the Consumer, you have the right to request a return without any reason within 14 days from the day you received the product purchases on www.ruerastudio.com.
    For more information on return procedures, please access the Returns & Refunds Policy section. Please read the sections carefully. The information is an integral part of these Conditions of Sale and has to be fully read and accepted by you at the time you submit your order.

  13. RETURN & REFUND POLICY
    1. RETURN POLICY
      1. The Consumer has the right to withdraw from the Contract, respectively to return a Good, within 14 days, without invoking any reason. Thus, according to GEO no. 34/2014, the period of returning a Good or giving up a Service expires within 14 days from the day on which the Goods come into the physical possession of the Consumer.
      2. The Consumer has the obligation to inform the Vendor regarding the return request by filling in a Return Form or by contacting the Vendor via email contact@ruerastudio.com. Also, if the 14 days term expires on a non-working day, the Consumer has the right to send the return the next working-day. If the order arrives late to our warehouse due to the shipping process, we will accept the return.
      3. Goods made to the Consumer’s specifications can NOT be returned. This condition may apply to made to measure products or custom-made articles.
      4. We offer a flexible returns policy to make your online shopping experience even easier. However, we do monitor the number of returns made and may refuse to accept orders at our discretion if goods are returned repeatedly.
        Return steps:
        a) Fill in the online Return Form, or contact the Vendor via email contact@ruerastudio.com giving information about your return request such as: your full name, email, order number, name of the products you want to return and the reason for your return if any. Once you complete this action, you will receive an email confirming your return request.
        b) Fill in your return slip received with the products and put it in your parcel. You will have to mention: your name, your order number, the items you’re returning and the reason you’re returning it to us if any. If you no longer have your returns slip, you can download a new one. 
        c) Make sure all returned items are sent in their original condition and packaging including all the tags, because they are an integral part of the product. If any item mentioned above is missing, we won’t accept your return.
        d) We don’t provide free return services, therefore you will have to support the return charges. Contact a courier of your choice or go to your nearest post office and send us the parcel. You can find our address in the return form received with the parcel.
        For Romania, the costs for sending your return vary between 20 – 40 Lei.
        For international orders, the costs for sending your return are similar to the shipping costs you cover within your order.
        e) Keep your proof of postage until we receive the parcel.
        f) The conditions for a return to be accepted:
            – The products you return must be in their original form.
            – Do not return products that have been used or washed.You may only try it in the same way you do in any physical store.
            – Do not remove the tags, because they are part of the product.
            – The products must be returned in their original package.
    2. REFUND TIMES AND PROCEDURES
      The Vendor must give you a refund within 14 days of receiving your return request.  However, we can delay refunding you if we haven’t received the goods or evidence that you’ve returned them. Also, for international orders, you will get a full refund including the shipping costs you paid to get your order.
      Refund steps:
      • Once we receive your return, we will check if the goods meet all the return requirements of the Return Policy.
      • You will receive an email that the products are accepted for return or if they don’t meet our return requirements and we identify a decrease of value and quality, you will receive an email informing you about two options: first one is not getting a refund and us keeping the damaged product or second we can deliver the product back to you at your own expense.
      • You will get your refund according to the payment method you chose for your order.
        For Credit/Debit Card, we will refund you the moment we accept your return, but the time for receiving your refund may be affected by your Credit Card company policies. 
    3. IDENTIFICATION TAG
      All products sold by www.ruerastudio.com include an identification tag with a disposable seal. Please try on the products without removing the tag and seal. Returned products without the tag or seal will not be accepted.
    4. FAULTY ITEMS OR WRONG ITEMS RECEIVED
      We are very sorry if you received a faulty or wrong item. Please let us know via email or by filling the online Return Form where you will mention that the reason for your return is receiving a faulty/wrong item. We will soon contact you back and give you details about how you can send back the product with shipping costs covered by us.
      • If you received something you haven’t ordered you have two options: first one is to exchange the product with the one you ordered and the second one is to give you a full refund after you send us the wrong product you received. In both cases, all delivery costs will be covered by us.
      • If you received a faulty item you have two options: first one is to exchange the faulty product with a new one and the second is to give you a full refund after you send us back the faulty product. In both cases, all delivery costs will be covered by us.
  14. AMENDMENTS AND UPDATES
    The Conditions of Sale may be changed or updated from time to time due to new laws and regulations or for other reasons.
